Anbieter und Geltungsbereich<\/h2>\n<p>\n  Anbieter der App <strong>MyWeight Assistant<\/strong> (nachfolgend \u201eMyWeight\u201c oder \u201edie App\u201c) ist:\n<\/p>\n<p>\n  Sebastian Lang<br>\n  Langfeldstra\u00dfe 11B<br>\n  91077 Neunkirchen am Brand<br>\n  Deutschland\n<\/p>\n<p>\n  E-Mail: <a href=\"mailto:info@langsoftware.de\">info@langsoftware.de<\/a><br>\n  Web: <a href=\"https:\/\/langsoftware.de\">https:\/\/langsoftware.de<\/a>\n<\/p>\n<p>\n  Diese Nutzungsbedingungen regeln die Nutzung der App f\u00fcr iPhone (Bezug \u00fcber den App Store von\n  Apple) und f\u00fcr Android (Bezug \u00fcber Google Play) sowie der damit verbundenen Online-Dienste\n  (Benutzerkonto und Cloud-Backup). Sie gelten zwischen dir und dem Anbieter. Abweichende\n  Bedingungen des Nutzers finden keine Anwendung.\n<\/p>\n<p>\n  Beide Versionen f\u00fchren dasselbe Gewichtstagebuch, unterscheiden sich aber im Funktionsumfang.\n  Bestimmungen, die nur f\u00fcr eine Plattform gelten, sind an der jeweiligen Stelle ausdr\u00fccklich\n  gekennzeichnet.\n<\/p>\n<p>\n  Erg\u00e4nzend gilt die <a href=\"https:\/\/langsoftware.de\/?page_id=233\">Datenschutzerkl\u00e4rung f\u00fcr MyWeight<\/a>.\n<\/p>\n\n<h2>2. Was die App leistet<\/h2>\n<p>\n  MyWeight ist ein digitales Gewichts- und K\u00f6rperma\u00df-Tagebuch. Du erfasst Gewicht, optional\n  K\u00f6rperfettanteil und Muskelmasse sowie K\u00f6rperma\u00dfe; die App stellt daraus Verl\u00e4ufe, Durchschnitts-\n  werte, den Body-Mass-Index und Diagramme dar und erinnert dich auf Wunsch ans Wiegen. Mit einem\n  Konto lassen sich alle Daten in der Cloud sichern und auf einem anderen Ger\u00e4t wiederherstellen.\n  Da beide Versionen dieselbe Cloud nutzen, ist die Wiederherstellung auch auf einem Ger\u00e4t der\n  jeweils anderen Plattform m\u00f6glich.\n<\/p>\n<p>\n  <strong>Nur in der iPhone-Version verf\u00fcgbar<\/strong> sind derzeit der Datenaustausch mit Apple\n  Health, der Import und Export von CSV-Dateien sowie das Anlegen mehrerer Profile auf einem Ger\u00e4t.\n  In der Android-Version stehen diese Funktionen nicht zur Verf\u00fcgung.\n<\/p>\n<p>\n  Der Funktionsumfang ergibt sich aus der jeweils aktuellen Beschreibung im App Store beziehungsweise\n  bei Google Play und aus der jeweils installierten Version. Ein Anspruch auf einen bestimmten\n  Funktionsumfang, auf Gleichheit des Funktionsumfangs beider Plattformen oder auf dessen dauerhafte\n  Beibehaltung besteht nicht; siehe dazu Ziffer 12.\n<\/p>\n\n<h2>3. Wichtiger Gesundheitshinweis<\/h2>\n<div class=\"mw-note\">\n  <p>\n    <strong>MyWeight ist kein Medizinprodukt und ersetzt keine \u00e4rztliche Beratung.<\/strong> Die App\n    dient ausschlie\u00dflich der Selbstdokumentation und der allgemeinen Information. Sie stellt keine\n    Diagnosen, gibt keine Therapieempfehlungen und ist nicht daf\u00fcr bestimmt, Krankheiten zu erkennen,\n    zu verh\u00fcten, zu \u00fcberwachen oder zu behandeln.\n  <\/p>\n  <p>\n    Berechnete Werte \u2013 insbesondere der Body-Mass-Index, Durchschnittskurven und Zielprognosen \u2013\n    sind vereinfachte Richtwerte. Sie ber\u00fccksichtigen keine individuellen medizinischen Umst\u00e4nde.\n  <\/p>\n  <p>\n    Triff keine Entscheidungen \u00fcber Ern\u00e4hrung, Gewichtsabnahme, Gewichtszunahme, Sport oder\n    Medikamente allein aufgrund der Angaben in der App. Wende dich bei gesundheitlichen Fragen,\n    starken Gewichtsver\u00e4nderungen oder Verdacht auf eine Essst\u00f6rung an eine \u00c4rztin oder einen Arzt.\n    Die App ist nicht f\u00fcr Personen mit einer diagnostizierten Essst\u00f6rung konzipiert.\n  <\/p>\n<\/div>\n\n<h2>4. Nutzungsvoraussetzungen<\/h2>\n<p>\n  F\u00fcr die Nutzung ben\u00f6tigst du ein kompatibles Endger\u00e4t \u2013 ein iPhone mit einer unterst\u00fctzten\n  iOS-Version oder ein Android-Ger\u00e4t mit einer unterst\u00fctzten Android-Version \u2013 und, f\u00fcr Backup und\n  Konto, eine Internetverbindung. Kosten f\u00fcr Datenverbindung und Endger\u00e4t tr\u00e4gst du selbst.\n<\/p>\n<p>\n  Die App richtet sich an Personen ab 16 Jahren. Bist du j\u00fcnger, darfst du die App nur mit Einwilligung\n  deiner Erziehungsberechtigten nutzen; f\u00fcr die Anlage eines Kontos ist deren Einwilligung zwingend.\n<\/p>\n\n<h2>5. Benutzerkonto und Cloud-Backup<\/h2>\n<p>\n  Die App ist ohne Konto nutzbar. Ein Konto ist ausschlie\u00dflich f\u00fcr das Cloud-Backup erforderlich. Die\n  Anmeldung ist mit Apple, Google, Facebook oder mit E-Mail-Adresse und Passwort m\u00f6glich.\n<\/p>\n<ul>\n  <li>Deine Zugangsdaten sind geheim zu halten und nicht an Dritte weiterzugeben.<\/li>\n  <li>Du bist f\u00fcr alle Handlungen verantwortlich, die \u00fcber dein Konto vorgenommen werden.<\/li>\n  <li>Bei Verdacht auf eine unbefugte Nutzung informiere uns bitte umgehend.<\/li>\n  <li>\n    Ein Konto ist personenbezogen. In der iPhone-Version kannst du innerhalb der App mehrere Profile\n    anlegen (z. B. f\u00fcr Familienmitglieder); diese werden gemeinsam unter deinem Konto gesichert. Die\n    Android-Version unterst\u00fctzt ein Profil je Ger\u00e4t.\n  <\/li>\n<\/ul>\n<p>\n  Das Cloud-Backup ist eine Komfortfunktion, <strong>keine Archivierungsgarantie<\/strong>. Es ersetzt\n  keine eigene Datensicherung. In der iPhone-Version empfehlen wir, zus\u00e4tzlich regelm\u00e4\u00dfig einen\n  CSV-Export anzulegen und au\u00dferhalb der App aufzubewahren; in der Android-Version steht ein solcher\n  Export derzeit nicht zur Verf\u00fcgung, dort ist das Cloud-Backup die einzige Sicherungsm\u00f6glichkeit.\n  F\u00fcr den Verlust von Daten haften wir nur nach Ma\u00dfgabe von Ziffer 11.\n<\/p>\n<p>\n  Du kannst dein Backup jederzeit in der App l\u00f6schen, ohne dein Konto aufzugeben, und du kannst dein\n  Konto vollst\u00e4ndig l\u00f6schen. Mit der L\u00f6schung des Kontos werden die zugeh\u00f6rigen Cloud-Daten entfernt;\n  Einzelheiten regelt die Datenschutzerkl\u00e4rung.\n<\/p>\n\n<h2>6. Kostenlose Version und Werbung<\/h2>\n<p>\n  MyWeight steht in einer kostenlosen Version zur Verf\u00fcgung. Diese finanziert sich \u00fcber Werbung, die\n  \u00fcber Google AdMob eingeblendet wird. Mit MyWeight Premium entf\u00e4llt die Werbung.\n<\/p>\n\n<h2>7. MyWeight Premium (Abonnement)<\/h2>\n<p>\n  MyWeight Premium schaltet zus\u00e4tzliche Funktionen frei. Welche Funktionen enthalten sind, wird dir in\n  der App vor dem Kauf angezeigt; derzeit sind dies unter anderem Werbefreiheit, das automatische\n  Cloud-Backup, die Erfassung von K\u00f6rperfett und Muskelmasse, die K\u00f6rperma\u00dfe samt Bildvergleich und\n  die App-Sperre. In der iPhone-Version geh\u00f6ren zus\u00e4tzlich mehrere Profile auf einem Ger\u00e4t dazu.\n<\/p>\n\n<h3>7.1 Vertragspartner und Abrechnung<\/h3>\n<div class=\"mw-note\">\n  <p>\n    <strong>Der Kaufvertrag \u00fcber das Abonnement kommt nicht mit dem Anbieter zustande, sondern mit\n    dem Store, \u00fcber den du die App bezogen hast.<\/strong>\n  <\/p>\n  <ul>\n    <li>\n      <strong>iPhone-Version:<\/strong> Vertragspartner ist Apple. Die Zahlung wird \u00fcber dein\n      Apple-Konto abgewickelt. Es gelten zus\u00e4tzlich die Bedingungen von Apple f\u00fcr den App Store.\n    <\/li>\n    <li>\n      <strong>Android-Version:<\/strong> Vertragspartner ist Google. Die Zahlung wird \u00fcber dein\n      Google-Konto abgewickelt. Es gelten zus\u00e4tzlich die Nutzungsbedingungen von Google Play.\n    <\/li>\n  <\/ul>\n<\/div>\n\n<h3>7.2 F\u00fcr beide Plattformen geltende Regelungen<\/h3>\n<ul>\n  <li>\n    Der Preis und die Laufzeit werden dir im Kaufdialog in deiner Landesw\u00e4hrung angezeigt, bevor du den\n    Kauf best\u00e4tigst.\n  <\/li>\n  <li>\n    Das Abonnement <strong>verl\u00e4ngert sich automatisch<\/strong> um die jeweilige Laufzeit, sofern die\n    automatische Verl\u00e4ngerung nicht sp\u00e4testens 24 Stunden vor Ende des laufenden Zeitraums deaktiviert\n    wird. Es wird nicht auf\n  die andere Plattform \u00fcbertragen: Ein im App Store gekauftes Abonnement schaltet die Android-Version\n  nicht frei und umgekehrt.\n<\/p>\n<p>\n  <strong>Widerrufsrecht:<\/strong> Als Verbraucher steht dir ein gesetzliches Widerrufsrecht zu. Da der\n  Vertrag \u00fcber den Kauf digitaler Inhalte mit Apple beziehungsweise Google zustande kommt, richtet sich\n  die Aus\u00fcbung nach den Bedingungen des jeweiligen Stores.\n<\/p>\n\n<h2>8. Rechte an der App<\/h2>\n<p>\n  Mit dem Herunterladen erh\u00e4ltst du ein einfaches, nicht ausschlie\u00dfliches, nicht \u00fcbertragbares Recht,\n  die App auf den von dir besessenen oder kontrollierten Ger\u00e4ten zu nutzen \u2013 bei der iPhone-Version\n  nach Ma\u00dfgabe der App-Store-Nutzungsregeln von Apple, bei der Android-Version nach Ma\u00dfgabe der\n  Nutzungsbedingungen von Google Play. Alle Rechte an der App, ihrem Quellcode, ihrer Gestaltung, den\n  Grafiken und den Marken verbleiben beim Anbieter beziehungsweise bei den jeweiligen Rechteinhabern.\n<\/p>\n<p>Untersagt sind insbesondere:<\/p>\n<ul>\n  <li>Zur\u00fcckentwicklung (Reverse Engineering), Dekompilierung und Disassemblierung, soweit nicht\n      gesetzlich zwingend erlaubt,<\/li>\n  <li>Vermietung, Verleih, Weiterverkauf und Unterlizenzierung der App,<\/li>\n  <li>das Umgehen technischer Schutzma\u00dfnahmen oder der Pr\u00fcfung des Premium-Status,<\/li>\n  <li>automatisierte oder missbr\u00e4uchliche Zugriffe auf die Backup-Dienste, die deren Betrieb\n      beeintr\u00e4chtigen k\u00f6nnen.<\/li>\n<\/ul>\n\n<h2>9. Deine Inhalte<\/h2>\n<p>\n  Die von dir erfassten Daten \u2013 Messwerte, Notizen und Bilder \u2013 bleiben deine Inhalte. Wir nutzen sie\n  ausschlie\u00dflich, um dir die Funktionen der App bereitzustellen, insbesondere um dein Backup zu\n  speichern und wiederherzustellen. Eine Auswertung deiner Inhalte zu Werbezwecken oder eine Weitergabe\n  oder ein Verkauf an Dritte findet nicht statt. Einzelheiten regelt die Datenschutzerkl\u00e4rung.\n<\/p>\n<p>\n  Du sicherst zu, keine rechtswidrigen Inhalte hochzuladen und keine Bilder Dritter ohne deren\n  Einwilligung zu speichern.\n<\/p>\n\n<h2>10. Verf\u00fcgbarkeit, Updates und Support<\/h2>\n<p>\n  Wir bem\u00fchen uns um einen m\u00f6glichst st\u00f6rungsfreien Betrieb der Backup-Dienste, schulden jedoch keine\n  bestimmte Verf\u00fcgbarkeit. Wartungsarbeiten, St\u00f6rungen bei Vorleistern (insbesondere Google Firebase)\n  oder Umst\u00e4nde h\u00f6herer Gewalt k\u00f6nnen zu vor\u00fcbergehenden Einschr\u00e4nkungen f\u00fchren. Die App selbst bleibt\n  auch ohne Internetverbindung nutzbar.\n<\/p>\n<p>\n  Ein Anspruch auf Bereitstellung von Updates besteht nicht, soweit nicht gesetzlich zwingend\n  vorgeschrieben. Das gilt auch f\u00fcr die Frage, ob und wann eine Funktion, die es auf einer Plattform\n  bereits gibt, auf der anderen bereitgestellt wird. Support erh\u00e4ltst du unter\n  <a href=\"mailto:info@langsoftware.de\">info@langsoftware.de<\/a>. Weder Apple noch Google sind\n  verpflichtet, Support- oder Wartungsleistungen f\u00fcr die App zu erbringen.\n<\/p>\n\n<h2>11. Haftung<\/h2>\n<p>\n  Wir haften unbeschr\u00e4nkt bei Vorsatz und grober Fahrl\u00e4ssigkeit, bei arglistigem Verschweigen eines\n  Mangels, bei der Verletzung von Leben, K\u00f6rper oder Gesundheit, im Rahmen einer \u00fcbernommenen Garantie\n  sowie nach dem Produkthaftungsgesetz.\n<\/p>\n<p>\n  Bei einfacher Fahrl\u00e4ssigkeit haften wir nur bei Verletzung einer wesentlichen Vertragspflicht, also\n  einer Pflicht, deren Erf\u00fcllung die ordnungsgem\u00e4\u00dfe Durchf\u00fchrung des Vertrags \u00fcberhaupt erst erm\u00f6glicht\n  und auf deren Einhaltung du regelm\u00e4\u00dfig vertrauen darfst. In diesem Fall ist die Haftung auf den bei\n  Vertragsschluss vorhersehbaren, vertragstypischen Schaden begrenzt.\n<\/p>\n<p>\n  Im \u00dcbrigen ist die Haftung ausgeschlossen. Insbesondere \u00fcbernehmen wir keine Haftung f\u00fcr\n  gesundheitliche Folgen von Entscheidungen, die du auf Grundlage der in der App dargestellten Werte\n  triffst (siehe Ziffer 3), sowie f\u00fcr Datenverluste, die du durch eine zumutbare eigene Sicherung \u2013\n  etwa ein Cloud-Backup oder, in der iPhone-Version, einen CSV-Export \u2013 h\u00e4ttest vermeiden k\u00f6nnen.\n<\/p>\n\n<h2>12. \u00c4nderungen der App und dieser Bedingungen<\/h2>\n<p>\n  Wir d\u00fcrfen die App weiterentwickeln, Funktionen erg\u00e4nzen und \u2013 soweit dies f\u00fcr dich zumutbar ist \u2013\n  auch einschr\u00e4nken oder einstellen, etwa aus technischen oder rechtlichen Gr\u00fcnden oder weil ein\n  Dienst eines Vorleisters entf\u00e4llt.\n<\/p>\n<p>\n  Diese Nutzungsbedingungen k\u00f6nnen wir mit Wirkung f\u00fcr die Zukunft \u00e4ndern, wenn dies aufgrund\n  ge\u00e4nderter Rechtslage, Rechtsprechung oder des Funktionsumfangs erforderlich ist und dich nicht\n  unangemessen benachteiligt. Die jeweils aktuelle Fassung wird auf dieser Seite ver\u00f6ffentlicht.\n  Widersprichst du einer \u00c4nderung, kannst du die Nutzung jederzeit beenden.\n<\/p>\n\n<h2>13. Laufzeit und Beendigung<\/h2>\n<p>\n  Du kannst die Nutzung jederzeit beenden, indem du die App l\u00f6schst. Dein Konto und dein Cloud-Backup\n  l\u00f6schst du in der App unter \u201eBackup\u201c. Ein laufendes Abonnement wird dadurch nicht automatisch beendet \u2013\n  dieses musst du zus\u00e4tzlich im jeweiligen Store k\u00fcndigen (siehe Ziffer 7.3).\n<\/p>\n<p>\n  Wir d\u00fcrfen ein Konto sperren oder l\u00f6schen, wenn du erheblich gegen diese Bedingungen verst\u00f6\u00dft,\n  insbesondere bei missbr\u00e4uchlicher Nutzung der Backup-Dienste. Bei geringf\u00fcgigen Verst\u00f6\u00dfen mahnen wir\n  vorher ab.\n<\/p>\n\n<h2>14. Erg\u00e4nzende Bestimmungen der App-Stores<\/h2>\n<p>\n  Je nachdem, \u00fcber welchen Store du die App bezogen hast, gelten erg\u00e4nzend die folgenden\n  Bestimmungen. Ziffer 14.1 gilt f\u00fcr die iPhone-Version, Ziffer 14.2 f\u00fcr die Android-Version.\n<\/p>\n\n<h3>14.1 App Store (Apple) \u2013 gilt f\u00fcr die iPhone-Version<\/h3>\n<ul>\n  <li>\n    Diese Nutzungsbedingungen bestehen ausschlie\u00dflich zwischen dir und dem Anbieter, <strong>nicht mit\n    Apple<\/strong>. Apple ist f\u00fcr die App und deren Inhalte nicht verantwortlich.\n  <\/li>\n  <li>\n    Verantwortlich f\u00fcr Support und Wartung der App ist allein der Anbieter. Apple trifft insoweit keine\n    Verpflichtung.\n  <\/li>\n  <li>\n    Sollte die App einer geltenden Garantie nicht entsprechen, kannst du Apple hier\u00fcber informieren;\n    Apple erstattet dir gegebenenfalls den Kaufpreis. Dar\u00fcber hinaus trifft Apple keine\n    Gew\u00e4hrleistungspflicht. Provider and scope<\/h2>\n<p>\n  The app <strong>MyWeight Assistant<\/strong> (the \u201eApp\u201c) is provided by:\n<\/p>\n<p>\n  Sebastian Lang<br>\n  Langfeldstrasse 11B<br>\n  91077 Neunkirchen am Brand<br>\n  Germany\n<\/p>\n<p>\n  E-mail: <a href=\"mailto:info@langsoftware.de\">info@langsoftware.de<\/a><br>\n  Web: <a href=\"https:\/\/langsoftware.de\">https:\/\/langsoftware.de<\/a>\n<\/p>\n<p>\n  These Terms govern your use of the app for iPhone (obtained from Apple&#8217;s App Store) and for Android\n  (obtained from Google Play), together with the related online services (user account and cloud\n  backup). They form an agreement between you and the provider. Our\n  <a href=\"https:\/\/langsoftware.de\/?page_id=233\">Privacy Policy for MyWeight<\/a> applies in addition.\n<\/p>\n<p>\n  Both versions keep the same weight diary but differ in the features they offer. Provisions that\n  apply to one platform only are marked as such where they appear.\n<\/p>\n\n<h2>2. What the App does<\/h2>\n<p>\n  MyWeight is a digital weight and body-measurement diary. You record your weight, optionally body fat\n  percentage and muscle mass, and body measurements; the App presents histories, averages, your body\n  mass index and charts, and reminds you to weigh in if you wish. With an account, all data can be\n  backed up to the cloud and restored on another device. As both versions use the same cloud, you can\n  also restore onto a device running the other platform.\n<\/p>\n<p>\n  <strong>Available in the iPhone version only<\/strong> are currently the exchange of data with Apple\n  Health, importing and exporting CSV files, and creating several profiles on one device. These\n  features are not available in the Android version.\n<\/p>\n<p>\n  The available features follow from the current App Store or Google Play description and from the\n  version installed. You have no claim to any particular feature, to feature parity between the two\n  platforms, or to permanent availability; see section 12.\n<\/p>\n\n<h2>3. Important health notice<\/h2>\n<div class=\"mw-note\">\n  <p>\n    <strong>MyWeight is not a medical device and does not replace medical advice.<\/strong> The App is\n    intended solely for self-documentation and general information. It does not diagnose, does not\n    recommend treatment, and is not intended to detect, prevent, monitor or treat any disease.\n  <\/p>\n  <p>\n    Calculated values \u2013 in particular body mass index, average curves and target projections \u2013 are\n    simplified guide values. They do not account for your individual medical circumstances.\n  <\/p>\n  <p>\n    Do not base decisions about nutrition, weight loss, weight gain, exercise or medication on the\n    App alone. Consult a physician if you have health concerns, experience pronounced weight changes,\n    or suspect an eating disorder. The App is not designed for people with a diagnosed eating disorder.\n  <\/p>\n<\/div>\n\n<h2>4. Requirements<\/h2>\n<p>\n  You need a compatible device \u2013 an iPhone running a supported version of iOS, or an Android device\n  running a supported version of Android \u2013 and, for the account and backup, an internet connection.\n  Costs for your device and data connection are yours to bear.\n<\/p>\n<p>\n  The App is intended for users aged 16 and over. If you are younger, you may use it only with the\n  consent of your legal guardian; for creating an account such consent is mandatory.\n<\/p>\n\n<h2>5. Account and cloud backup<\/h2>\n<p>\n  The App works without an account. An account is required only for the cloud backup. You can sign in\n  with Apple, Google, Facebook, or with an e-mail address and password.\n<\/p>\n<ul>\n  <li>Keep your credentials confidential and do not share them with third parties.<\/li>\n  <li>You are responsible for all activity carried out through your account.<\/li>\n  <li>Please notify us immediately if you suspect unauthorised use.<\/li>\n  <li>\n    An account is personal. In the iPhone version you may create several profiles within the App (for\n    example for family members); these are backed up together under your account. The Android version\n    supports one profile per device.\n  <\/li>\n<\/ul>\n<p>\n  The cloud backup is a convenience feature, <strong>not an archiving guarantee<\/strong>. It does not\n  replace your own backups. In the iPhone version we recommend exporting your data as CSV from time to\n  time and keeping that file outside the App; the Android version currently offers no such export, so\n  there the cloud backup is the only way to secure your data. Our liability for data loss is governed\n  by section 11.\n<\/p>\n<p>\n  You can delete your backup at any time inside the App without giving up your account, and you can\n  delete your account entirely. Deleting the account removes the associated cloud data; details are set\n  out in the Privacy Policy.\n<\/p>\n\n<h2>6. Free version and advertising<\/h2>\n<p>\n  MyWeight is available as a free version financed by advertising delivered through Google AdMob.\n  MyWeight Premium removes the advertising.\n<\/p>\n\n<h2>7. MyWeight Premium (subscription)<\/h2>\n<p>\n  MyWeight Premium unlocks additional features. The App shows you which features are included before\n  you purchase; these currently include an ad-free experience, automatic cloud backup, recording body\n  fat and muscle mass, body measurements with photo comparison, and the app lock. In the iPhone\n  version they also include multiple profiles on one device.\n<\/p>\n\n<h3>7.1 Contracting party and billing<\/h3>\n<div class=\"mw-note\">\n  <p>\n    <strong>The subscription contract is not concluded with the provider but with the store from\n    which you obtained the App.<\/strong>\n  <\/p>\n  <ul>\n    <li>\n      <strong>iPhone version:<\/strong> your contracting party is Apple. Payment is charged to your\n      Apple account. Apple&#8217;s App Store terms apply in addition.\n    <\/li>\n    <li>\n      <strong>Android version:<\/strong> your contracting party is Google. Payment is charged to your\n      Google account. The Google Play Terms of Service apply in addition.\n    <\/li>\n  <\/ul>\n<\/div>\n\n<h3>7.2 Provisions applying to both platforms<\/h3>\n<ul>\n  <li>\n    Price and term are shown in your local currency in the purchase dialog before you confirm.\n  <\/li>\n  <li>\n    The subscription <strong>renews automatically<\/strong> unless auto-renewal is switched off at least\n    24 hours before the end of the current period. It does not carry over to the\n  other platform: a subscription purchased in the App Store does not unlock the Android version, and\n  vice versa.\n<\/p>\n<p>\n  <strong>Right of withdrawal:<\/strong> as a consumer you have a statutory right of withdrawal. As the\n  contract for the digital content is concluded with Apple or Google respectively, exercising it\n  follows the terms of the relevant store.\n<\/p>\n\n<h2>8. Rights in the App<\/h2>\n<p>\n  On download you receive a limited, non-exclusive, non-transferable right to use the App on devices\n  that you own or control \u2013 for the iPhone version in accordance with Apple&#8217;s App Store Usage Rules,\n  for the Android version in accordance with the Google Play Terms of Service. All rights in the App,\n  its source code, design, graphics and trademarks remain with the provider or the respective rights\n  holders.\n<\/p>\n<p>The following are prohibited in particular:<\/p>\n<ul>\n  <li>reverse engineering, decompiling and disassembling, unless mandatorily permitted by law;<\/li>\n  <li>renting, lending, reselling and sublicensing the App;<\/li>\n  <li>circumventing technical protection measures or the premium status check;<\/li>\n  <li>automated or abusive access to the backup services that may impair their operation.<\/li>\n<\/ul>\n\n<h2>9. Your content<\/h2>\n<p>\n  The data you record \u2013 measurements, notes and images \u2013 remains your content. We use it solely to\n  provide the App&#8217;s features, in particular to store and restore your backup. Your content is not\n  analysed for advertising purposes and is neither passed on nor sold to third parties. Details are set\n  out in the Privacy Policy.\n<\/p>\n<p>\n  You undertake not to upload unlawful content and not to store images of other people without their\n  consent.\n<\/p>\n\n<h2>10. Availability, updates and support<\/h2>\n<p>\n  We aim to keep the backup services running smoothly but do not owe any particular level of\n  availability. Maintenance, disruptions at upstream providers (in particular Google Firebase) or force\n  majeure may cause temporary restrictions. The App itself remains usable without an internet\n  connection.\n<\/p>\n<p>\n  There is no claim to the provision of updates unless required by mandatory law. The same applies to\n  whether and when a feature that already exists on one platform will be made available on the other.\n  Support is available at <a href=\"mailto:info@langsoftware.de\">info@langsoftware.de<\/a>. Neither Apple\n  nor Google has any obligation to furnish maintenance or support services for the App.\n<\/p>\n\n<h2>11. Liability<\/h2>\n<p>\n  We are liable without limitation for intent and gross negligence, for fraudulent concealment of a\n  defect, for injury to life, body or health, under a guarantee we have assumed, and under the German\n  Product Liability Act.\n<\/p>\n<p>\n  In cases of slight negligence we are liable only for the breach of a material contractual obligation,\n  that is an obligation whose fulfilment is essential to the proper performance of the contract and on\n  whose observance you may regularly rely. In that case liability is limited to the foreseeable damage\n  typical for this type of contract.\n<\/p>\n<p>\n  Liability is otherwise excluded. In particular we accept no liability for health consequences of\n  decisions you take on the basis of values shown in the App (see section 3), nor for data loss you\n  could have avoided by a reasonable backup of your own, such as a cloud backup or, in the iPhone\n  version, a CSV export.\n<\/p>\n\n<h2>12. Changes to the App and to these Terms<\/h2>\n<p>\n  We may continue to develop the App, add features and \u2013 where reasonable for you \u2013 restrict or\n  discontinue them, for example for technical or legal reasons or because a service we depend on ceases\n  to exist.\n<\/p>\n<p>\n  We may amend these Terms with effect for the future where this is necessary due to changes in the\n  law, in case law or in the scope of features, and where it does not unreasonably disadvantage you.\n  The current version is published on this page. If you object to a change, you may stop using the App\n  at any time.\n<\/p>\n\n<h2>13. Term and termination<\/h2>\n<p>\n  You may stop using the App at any time by deleting it. You delete your account and cloud backup in the\n  App under \u201eBackup\u201c. This does not automatically end a running subscription \u2013 you must additionally\n  cancel it in the relevant store (see section 7.3).\n<\/p>\n<p>\n  We may suspend or delete an account if you materially breach these Terms, in particular in the case of\n  abusive use of the backup services. In the case of minor breaches we will warn you first.\n<\/p>\n\n<h2>14. Additional terms of the app stores<\/h2>\n<p>\n  Depending on the store from which you obtained the App, the following additional terms apply.\n  Section 14.1 applies to the iPhone version, section 14.2 to the Android version.\n<\/p>\n\n<h3>14.1 App Store (Apple) \u2013 applies to the iPhone version<\/h3>\n<ul>\n  <li>\n    These Terms are concluded between you and the provider only, <strong>not with Apple<\/strong>. Apple\n    is not responsible for the App or its content.\n  <\/li>\n  <li>\n    The provider alone is responsible for maintenance and support of the App. Apple has no obligation\n    in this respect.\n  <\/li>\n  <li>\n    In the event of any failure of the App to conform to any applicable warranty, you may notify Apple,\n    and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other\n    warranty obligation whatsoever. Claims for defects are directed to the provider.\n  <\/li>\n  <li>\n    The provider alone is responsible for addressing any claims relating to the App, including product\n    liability claims, claims that the App fails to conform to legal or regulatory requirements, and\n    claims arising under consumer protection law.\n  <\/li>\n  <li>\n    In the event of a third-party claim that the App infringes intellectual property rights, the\n    provider alone is responsible for the defence and settlement of that claim.\n  <\/li>\n  <li>\n    You represent that you are not located in a country subject to a U.S. Government embargo or\n    designated as a \u201eterrorist supporting\u201c country, and that you are not listed on any U.S. Government\n    list of prohibited or restricted parties.\n  <\/li>\n  <li>\n    Apple and its subsidiaries are <strong>third-party beneficiaries<\/strong> of these Terms and have\n    the right to enforce them against you.\n  <\/li>\n<\/ul>\n\n<h3>14.2 Google Play \u2013 applies to the Android version<\/h3>\n<ul>\n  <li>\n    These Terms are concluded between you and the provider only, <strong>not with Google<\/strong>.\n    Google is not responsible for the App or its content.\n  <\/li>\n  <li>\n    The provider alone is responsible for maintenance and support of the App. Google has no obligation\n    in this respect.\n  <\/li>\n  <li>\n    Claims for defects in the App, as well as product liability claims, claims that the App fails to\n    conform to legal or regulatory requirements, and claims arising under consumer protection law, are\n    directed against the provider alone.\n  <\/li>\n  <li>\n    In the event of a third-party claim that the App infringes intellectual property rights, the\n    provider alone is responsible for the defence and settlement of that claim.\n  <\/li>\n  <li>\n    The <a href=\"https:\/\/play.google.com\/intl\/en\/about\/play-terms\/\">Google Play Terms of Service<\/a>\n    apply in addition, as amended from time to time. Governing law and dispute resolution<\/h2>\n<p>\n  German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If\n  you are a consumer habitually resident in another EU member state, the mandatory consumer protection\n  provisions of that state remain unaffected.\n<\/p>\n<p>\n  We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer\n  arbitration board.\n<\/p>\n\n<h2>16. Final provisions<\/h2>\n<p>\n  Should any provision of these Terms be or become invalid, the validity of the remaining provisions\n  remains unaffected.
